Lyvely Privacy Policy 2023

Introduction

Lyvely is an online monetization platform and social network for Creators (“Content Creators, Professionals, Freelancers, Entertainers, Consultants, and more”) to advertise and sell their digital goods, content, and services (“Creator Content”) and allows Creators’ fans and followers (“Supporters”) to purchase such Creator Content using the Lyvely platform (collectively, the “Service”).

Content and data on some of our Services is viewable to non-members (“Visitors”).

Lyvely is a company registered in the UK and the UAE, operating globally online. By using our platform, you agree that your personal information that you provide directly to us, or that we collect through your use of the platform, may be transferred to and stored in the United Kingdom and handled as described in this Policy.

Changes

Lyvely (“we” or “us”) can update and modify this Privacy Policy as needed. If we make material changes to it, we will provide notice through our Services, or by other means, to provide you the opportunity to review the changes before they become effective.

You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Privacy Policy means that the collection, use and storage of your personal data is subject to the updated Privacy Policy, as of its effective date.

Information You Provide Through Your Account

This is information that you provide to us through text fields, such as your name, location, profession or other. The information we collect differs depending on whether you make an account, become a customer or become a monetizing creator. This information includes:

  • First and Last Name
  • Email Address
  • Username
  • Password
  • State and Country of Residence

Please note: Lyvely does not collect, hold or store your payment information. All payment information is submitted to and processed/stored via Stripe. To read Stripe’s privacy policy, please click here

You may also sign up using a Google account. We will ask for permission to access basic information from your Google account, such as your name, email and profile picture. You can choose to stop sharing that information with us at any time by going to Google to remove Lyvely’s access to that account and your ability to log in.

You also have the option to add more information to your public profile, such as a location, social media links and an about section, which we store along with any comments or messages you submit on Lyvely.

Cookies

We use cookies to operate and administer our Site, gather usage data on our Site, and improve your experience on it. A “cookie” is a piece of information sent to your browser by a website you visit. Cookies can be stored on your computer for different periods of time. Some cookies expire after a certain amount of time, or upon logging out (session cookies), others survive after your browser is closed until a defined expiration date set in the cookie (as determined by the third party placing it), and help recognize your computer when you open your browser and browse the Internet again (persistent cookies). Analytics

We use Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses cookies to help us analyze how users use the Site and enhance your experience when you use the Site. Collected Information

We collect information automatically as you navigate the site or through our third-party analytics providers. We may store usage information such as the type of device you use to access Lyvely, your operating system, browser type, IP address, device ID, the pages you visit or request, links clicked, referring sites, user interactions and your search terms. We also derive your location from your self-disclosed country, your IP address and your payment card.

User Surveys

From time to time, we may ask for your participation in user surveys. In order to better understand and serve our user base, we may ask you for demographic information, including information related to your gender, ethnicity, race, age, sexual orientation, earnings and accessibility, which you may choose to share or not. We collect such information to ensure we provide fair and equal access to our services and to showcase creators to patrons for greater discoverability. We will store your survey responses as and when you participate in the surveys.

Event Information

We may request information from you at in-person and online events. This is done to better tailor the event experience to those attending. This information may include your name, email address, payment details, mobile phone number and QR code, demographic information, social media and other online accounts you maintain, details around the types of works you create, and survey or feedback responses.

Blogs

We may collect and store your email address, your comments and your profile information from our blog sites to better understand your interests and improve our services to you.

Cookies

We use Cookies on our website that collect information to allow us and third parties to understand your use of Lyvely. Cookies are not strictly necessary for the website to work, but it will provide you with a better browsing experience. If you choose to delete or block these cookies, some features of this site may not work as intended. Cookies are not used to identify you personally and are not used for any purpose other than those described here.

Security / Authentication

Some cookie and similar technology functions are necessary and vital to ensuring that Lyvely works properly for visitors and members, such as maintaining the security, safety, and integrity on Lyvely, authentication and logging in (including remembering permissions and consents you have granted), and ensuring the ability to securely complete transactions.

Performance / Analytics and Research

Some technologies help provide performance data on how Lyvely is functioning in order to make improvements to the platform. Data collected on site and app functionality and speed, how Lyvely is used, and detecting or gathering reporting on bugs to help improve the services we offer.

Preferences / Localization

Cookies enable your personalized views and settings. Some cookies help us provide localized experiences — for example, by making sure you see Lyvely in your preferred language.

Social Networks / Marketing

Some technologies help you to interact with social networks you are signed into while using Lyvely, such as logging in with the social network and other features you employ with the social network, or that are allowed in the social network’s privacy policy. These may be set and controlled by the social networks, and your preferences with those social networks.

Social Media Features and Widgets

We may use social media features, including interactive buttons or similar. If you provide your social media information to us, we may use it to interact with you on these social networks. These features may collect your IP address and other personal data, including which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or directly on Lyvely. Your interactions with these Features are governed by the privacy policy of the company providing it. Information We Share with Creators

By becoming a supporter of a creator, you agree to have the following information shared with that creator:

  • your name and email address, and other profile information you’ve provided
  • your phone number, when you have signed up to support a creator who engages with you via text messages, when you are receiving a benefit that requires shipping, or when you have signed up for event notifications via text
  • all information about your pledge, including amount and start date but not your full payment card information
  • some aggregated and anonimised data about how you use Lyvely that cannot be linked back to you or to any individual user

Creators agree to the terms of our Data Processing Agreement (DPA) when they start their membership programme. This DPA is called the Creator Privacy Promise. The Creator Privacy Promise is a creator’s promise to protect the privacy of their supporters during and beyond their Lyvely relationship. You can view a copy of the Creator Privacy Promise here.

How we use your personal information

We may use personal information for the following purposes:

• To provide you with access to or use of the Services or functionality, including sharing personal information of Customers with Creators they purchase goods or services from, and to analyze your use of such Services or functionality;

  • To respond to your inquiries, comments, feedback, or questions;
  • To send administrative information to you, for example, information regarding the Service and changes to our terms, conditions, and policies;
  • To analyze how you interact with our Service;
  • To maintain and improve the Service;
  • To develop new products and services;
  • To prevent fraud, criminal activity, or misuses of our Service, and to ensure the security of our IT systems, architecture, and networks; and
  • To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.

Aggregated Information

We may aggregate personal information and use the aggregated information to analyze the effectiveness of our Service, to improve and add features to our Service, and for other similar purposes. In addition, from time to time, we may analyze the general behavior and characteristics of users of our Service and share aggregated information like general user statistics with prospective business partners. We may collect aggregated information through the Service, through cookies, and through other means described in this Privacy Policy.

Marketing. We may use your personal information to contact you to tell you about products or services we believe may be of interest to you. For instance, if you elect to provide your email or telephone number, we may use that information to send you special offers. You may opt out of receiving emails by following the instructions contained in each promotional email we send you. You can also control the marketing emails and/or text messages you receive by updating your settings through your account. In addition, if at any time you do not wish to receive future marketing communications, you may contact us. If you unsubscribe from our marketing lists, you will no longer receive marketing communications but we will continue to contact you regarding management of your account, other administrative matters, and to respond to your requests.

Exercising Your Data Rights

Users in certain locations may have certain rights under the General Data Protection Regulation (GDPR) or under the California Consumer Privacy Act (CCPA) regarding data that Lyvely controls as a Data Controller as defined under the GDPR, including:

  • the right of access to their personal data,
  • the right to correct or rectify any inaccurate personal data,
  • the right to restrict or oppose the processing of personal data,
  • the right to erase or delete their personal data
  • the right to personal data portability, and
  • the right to opt-out of the sale of personal information.

You can exercise rights over your data on Lyvely in the following ways:

  • accessing, reviewing, modifying, and updating your data by logging into your account at Lyvely and going to your account settings.
  • viewing our privacy policy or viewing our data practices by going online to our Lyvely Privacy Center.
  • downloading your data to port it, or deleting your data altogether, by clicking on the “Make a Privacy Request” button at the Lyvely Privacy Center.
  • deleting a previously-disabled account by emailing Lyvely at privacy@lyvely.com.
  • opting out of marketing by entering your email address at this opt out link.
  • going to FAQ section or customer support for data-related issues.

If you are unable to log into your account, and are unable to recover your account with a password reset in order to lodge your privacy request, then you may reach out to privacy@lyvely.com. We reserve the right to decline you access to or recovery of your account, at our discretion, to prevent an unauthorized takeover of your account.

California privacy rights disclosures

Where provided for by law and subject to any applicable exceptions, California residents may have the right:

  • To know the categories of personal information that Lyvely has collected about you, the business purpose for collecting your personal information, and the categories of sources from which the personal information was collected;
  • To access the specific pieces of personal information that Lyvely has collected about you;
  • To know whether Lyvely has disclosed your personal information for business purposes, the categories of personal information so disclosed, and the categories of third parties to whom we have disclosed your personal information;
  • To have Lyvely, under certain circumstances, delete your personal information;
  • To instruct businesses that sell personal information to stop doing so – Lyvely, however, does notsell personal information; and
  • To be free from discrimination related to the exercise of these rights.

If you would like to exercise any or all of these rights, you may do so by contacting us. After we receive your request, we may request additional information from you to verify your identity. Your authorized agent may submit requests in the same manner, although we may require the agent to present signed written permission to act on your behalf, and you may also be required to independently verify your identity with us and confirm that you have provided the agent permission to submit the request.

Compliance with EU Privacy Laws and Privacy Shield

Lyvely is an international company that complies with the General Data Protection Regulation (GDPR). We act as Data Controllers, as defined under the GDPR, and we process personal data based on our legitimate interests and for contractual necessity in providing you the Service, as described in “How We Use Your Information”. We also process and share personal information based on notification and users’ consent, which our users may revoke at any time.

Lyvely relies on various legal bases to lawfully execute international transfers of personal information, including standard contract clauses approved by the European Commission.

Lyvely complies with the EU-US Privacy Shield Framework and Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union and Switzerland to the United States. Lyvely has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles take precedence. Lyvely is responsible for the processing of personal information it receives or subsequently transfers to a third party acting as an agent on Lyvely’s behalf. Lyvely complies with the Privacy Shield Principles for all onward transfers of personal information, including the onward transfer liability provisions.

With respect to the personal information received or transferred pursuant to the Privacy Shield Frameworks, Lyvely is subject to the regulatory enforcement powers of the US Federal Trade Commission.

Links To Other Websites

The Service may contain links to other websites not operated or controlled by Lyvely, including social media services (“Third Party Sites”). The information that you share with Third Party Sites will be governed by the specific privacy policies and terms of service of the Third Party Sites and not by this Privacy Policy. By providing these links we do not imply that we endorse or have reviewed these sites. Please contact the Third Party Sites directly for information on their privacy practices and policies.

Security

You use the Service at your own risk. We implement commercially reasonable technical, administrative, and organizational measures to protect personal information both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. However, no Internet or e-mail transmission is ever fully secure or error free. In particular, e- mail sent to or from us may not be secure. Therefore, you should take special care in deciding what information you send to us via the Service or e-mail. Please keep this in mind when disclosing any personal information to Lyvely via the Internet. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service, or third party websites.

International Users

By using our Service, you understand and acknowledge that your personal information will be transferred from your location to our facilities and servers in the United Kingdom.

Children

Our Service is not directed to children who are under the age of 18. Lyvely does not knowingly collect personal information from children under the age of 18. If you have reason to believe that a child under the age of 18 has provided personal information to Lyvely through the Service please contact us and we will endeavor to delete that information from our databases.

Your Choices

In certain circumstances providing personal information is optional. However, if you choose not to provide personal information that is needed to use some features of our Service, you may be unable to use those features.
